Our Policy
When making a reservation through this WEBSITE (the website you are accessing to make the reservation), you and your companions expressly and without reservations accept these booking conditions.
Regarding the involved parties:
- You (hereinafter TRAVELER) are making the reservation directly with the chosen accommodation (hereinafter ACCOMMODATION).
- This WEBSITE is merely an intermediary that displays the accommodation at the request of the ACCOMMODATION itself. It has no responsibility for the reservations made by the TRAVELER unless the WEBSITE belongs to the ACCOMMODATION itself, in which case both entities are understood to be the same.
- AvaiBook On-line S.L (hereinafter AVAIBOOK), a legally constituted Spanish company with CIF ES-99279622, owns an independent online booking system that both the ACCOMMODATION and the WEBSITE have chosen to manage reservations.
- The AVAIBOOK system guarantees an independent and secure management of reservations, offering a standard framework that establishes the commitments of both the ACCOMMODATION and the TRAVELER, aiming to ensure reservations for both parties. In case of non-compliance with any of these conditions, AVAIBOOK will not be responsible, but rather the ACCOMMODATION and/or the TRAVELER. In such cases, AVAIBOOK will attempt to facilitate a solution by any means within its capabilities.
The contractual relationship derived from your reservation is formalized directly between the TRAVELER and the ACCOMMODATION. The ACCOMMODATION is solely responsible for the contracted tourism products and/or services.
CLAUSES
RESPONSIBILITY FOR INFORMATION
The data appearing about the ACCOMMODATION in this process has been entered directly by the owner of the ACCOMMODATION, so the WEBSITE and AVAIBOOK are not responsible for any error or omission that may affect both the successful completion of the reservation and the client's stay.
RESERVATION PROCESS
The reservation process requests all the necessary information to formalize the contract, including the check-in and check-out dates, and the TRAVELER's data as the person making the reservation. The TRAVELER is responsible for entering the data correctly and checking the dates and ACCOMMODATION information.
The owner/manager of the ACCOMMODATION has chosen for the reservation process to work in Online mode (Immediate Confirmation), and this is indicated in the reservation process. Therefore, the reservation confirmation is only pending the confirmation of the advance payment.
To confirm the reservation, an advance payment must be made, which corresponds to a part of the total reservation amount determined by the ACCOMMODATION, plus any possible Management Fees for the reservation management. These amounts are itemized in the reservation process.
The reservation process may offer different payment methods to the TRAVELER for making the advance payment. The payment methods that appear are chosen by the ACCOMMODATION and are payment gateways provided by AVAIBOOK within the reservation system, as an additional technical resource for the ACCOMMODATION. In such cases, the payment is automatically validated by the AVAIBOOK system, providing an independent system validation to the ACCOMMODATION that confirms the payment.
Depending on the chosen payment method, the TRAVELER has a limited time (a period informed to the TRAVELER) to make the payment, which must be validated by AVAIBOOK (automatically and instantly if it is an online payment method - card or PayPal -, or deferred if it is a non-online payment method - bank transfer -). If the payment is not validated within the period, the reservation will be automatically canceled, and the TRAVELER will be notified by email. In this case, any amount already paid (assuming a payment made but not validated in time) will be returned to the TRAVELER, but the reservation confirmation will not be obtained.
Once the advance payment is confirmed, the TRAVELER will receive the reservation voucher by email and it will be displayed on the screen, indicating the ACCOMMODATION's contact details and all necessary information.
The TRAVELER must print and keep this voucher to present it at the ACCOMMODATION's reception office, as well as present any other documentation indicated during the reservation process or in the emails received.
The remaining amount of the reservation (if the ACCOMMODATION has configured an advance payment less than the total reservation amount) will be paid directly at the ACCOMMODATION in the manner and time indicated by the ACCOMMODATION, independently of the reservation process.
THE PRICE INCLUDES
The price is per stay and accommodation and includes all applicable taxes and services.
THE PRICE DOES NOT INCLUDE
Extras not selected in the reservation process or additional services not expressly indicated in the reservation voucher or the ACCOMMODATION's profile, which must be contracted and paid upon arrival.
Any deposit stipulated by the ACCOMMODATION.
MAXIMUM CAPACITY AND ACCOMMODATION CONDITIONS
The number of people occupying the ACCOMMODATION cannot exceed the indicated capacity, except in the case of babies (under 3 years old). If the maximum capacity is not indicated, it will be understood as 2 people per double or matrimonial bed, and 1 per single or extra bed.
The ACCOMMODATION may refuse entry to people exceeding the contracted capacity, with no claim possible for this reason.
Pets are only allowed if expressly stated in the ACCOMMODATION's reservation conditions or by agreement with the ACCOMMODATION's owner. If this rule is violated, the ACCOMMODATION may demand eviction without compensation for you.
The TRAVELER agrees to keep the ACCOMMODATION clean, tidy, and in the condition it was delivered. They also agree to follow the use and maintenance instructions indicated by the ACCOMMODATION's owner and to respect the noise, garbage collection, water consumption, etc., regulations of the community, environment, or building where it is located.
Failure to comply with these rules entitles the ACCOMMODATION to demand eviction without compensation and to charge for damages, which may be deducted from the deposit.
KEY COLLECTION AND DEPARTURES
Key collection will be at the address and date indicated in the reservation voucher.
If arriving outside this schedule, or on weekends or holidays, you must contact the ACCOMMODATION to coordinate key delivery, and it is mandatory to notify the approximate arrival time. Failure to do so, or if the arrival does not occur within the scheduled hours, the ACCOMMODATION may dispose of the reserved accommodation, canceling the reservation without compensation for the TRAVELER.

CANCELLATION POLICY
The AVAIBOOK platform offers a trust framework for ACCOMMODATIONS and TRAVELERS, acting as a "trusted third party" that safeguards the advance payment to guarantee the cancellation policy configured by the ACCOMMODATION, which determines the date until which the TRAVELER can cancel with the right to a refund of the advance payment (in which case AVAIBOOK handles the refund to the TRAVELER - excluding management fees which are €1 + 2% of the advance payment if the payment was made by card or transfer, or €1.35 + 3.4% of the advance payment for payments using PayPal, plus a possible portal commission * -). After this date, the advance payment amount is available and safeguarded by the ACCOMMODATION, and any particular cancellation conditions it may have, or a specific agreement reached between the TRAVELER and the ACCOMMODATION, will apply.
* there may eventually be a "non-refundable" commission by the portal, in cases of reservations initiated from the portal, in which case this commission is considered part of the "management fees".
CANCELLATION POLICY GUARANTEED BY AVAIBOOK:
- You can cancel with the right to a refund of the advance payment (minus management fees), before 10 days before the check-in date.

In this case, the ACCOMMODATION's cancellation policy is as follows:
NO CANCELLATION POLICY DEFINED BY THE ACCOMMODATION.
AVAIBOOK will act as an impartial mediator between both parties, controlling at all times what resolution corresponds to each cancellation according to the cancellation policy accepted by both parties at the time of booking. For this purpose, whenever a cancellation occurs, it will communicate to both parties the resolution that corresponds by interpreting the cancellation policy informed and accepted by the parties when the reservation was confirmed.
AVAIBOOK will manage the refund of the advance payment to the TRAVELER in case of a cancellation within the established period. If it is a cancellation after this period, the management will be carried out directly by the ACCOMMODATION, according to its particular conditions if any, or according to a specific agreement reached between the ACCOMMODATION and the TRAVELER, in which case AVAIBOOK has no management responsibility.
The ACCOMMODATION accepts and authorizes AVAIBOOK to manage the funds received from a reservation according to the cancellation policy and guarantees informed here.
The TRAVELER accepts that in the event of a refund, AVAIBOOK will deduct the Management Fees, plus the commissions incurred in managing this operation, which will be informed to both the TRAVELER and the Owner in case of a cancellation.
Regardless of the cancellation policy in force and accepted by both parties at the time of a reservation, AVAIBOOK always allows both parties to reach a bilateral agreement to resolve the issue.
AVAIBOOK always keeps a record of the cancellation policy in force and accepted by both parties at the time of a reservation, the data demonstrating that both parties accepted it, and as an impartial entity, it will make these records available to both parties or their legal representatives, as well as to any official body that requires it, demonstrating the commitment made by both parties at the time of booking.
VALIDATIONS AND GUARANTEES OF THE ACCOMMODATION IN AVAIBOOK
As an impartial technical tool for the reservation process, AVAIBOOK allows the ACCOMMODATION to perform validations that provide security and guarantees to the TRAVELER. The validations and guarantees provided by this ACCOMMODATION are:
- Signed contract: the express conditions related to the use contract of AVAIBOOK (keeping the availability calendar always updated to avoid overbooking) have been accepted as follows: Implicit acceptance through registration in AVAIBOOK
- ACCOMMODATION validation: validation of the physical existence of the accommodation at the address indicated in its profile: PIEDRA BERMEJA, 10, 38916 (Guarazoca), Santa Cruz de Tenerife. Validated Not validated
- Total antifraud guarantee: the accommodation can voluntarily provide the antifraud guarantee consisting of AVAIBOOK retaining the advance payment and sending it 2 days after the check-in date. This guarantee only applies to reservations paid through "AvaiBook" payment methods. Deactivated Activated
- Cancellation policy: the ACCOMMODATION commits to a specific cancellation policy and its management as defined in the clause CANCELLATION POLICY.
The permanently updated availability calendar of AVAIBOOK prevents the possibility of overbooking in ACCOMMODATIONS that work with this system, but in case of overbooking, the OWNER will prioritize the reservation made through AVAIBOOK or, failing that, provide the TRAVELER with accommodation of equal or superior quality at the same or lower cost for the desired dates, taking care of the management and any additional costs incurred.
If the mentioned option is not possible, or the TRAVELER does not accept the change, the reservation will be canceled, and the total amounts paid as an advance payment for the reservation will be refunded. This refund will be the direct responsibility of the OWNER, and if the advance payment amount is retained by AVAIBOOK and at the request of both PARTIES, AVAIBOOK will make the refund directly to the TRAVELER, always deducting the commissions charged by AVAIBOOK. Any other agreement between the PARTIES replaces the previous conditions.
PAYMENT POLICY
The establishment may charge the remaining amount of the reservation on the check-in date.
DATA PROTECTION
The personal data provided by you are processed according to AVAIBOOK's Data Protection conditions (http://www.avaibook.com/aviso_legal.php point 11), as it is the technical tool through which the reservation is managed.
These data are made available to the ACCOMMODATION so that it can provide the requested service. The ACCOMMODATION itself commits to making proper use of the data according to current legislation.
APPLICABLE LAW AND JURISDICTION
In everything not provided for in these conditions, the legislation corresponding to the ACCOMMODATION in question will apply.
The parties, expressly waiving the jurisdiction that may correspond to them by law, submit to the jurisdiction and competence of the Courts and Tribunals of the city corresponding to the ACCOMMODATION in question for the resolution of any problem arising from the application and interpretation of this contract.
